These Terms of Service ("Terms") govern your use of Project Commander ("the App"), a Jira Cloud app distributed through the Atlassian Marketplace. By installing or using the App, you agree to these Terms.
By installing, accessing, or using Project Commander, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the App.
If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
Project Commander is a Jira Cloud app delivered as a full-page Jira app and dashboard gadget. It provides:
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the App in connection with your Jira Cloud instance.

The Jira Cloud app is distributed as an Atlassian Forge app. Depending on the distribution method, your use may also be subject to:
In case of conflict between these Terms and Atlassian's terms, Atlassian's terms shall prevail with respect to your use of the Atlassian platform.
While the App is in public beta, all features are available at no charge through the Atlassian Marketplace. No credit card or separate agreement is required.
Customers installing via the Atlassian Marketplace are charged according to the pricing displayed on the Marketplace listing. Billing, refund policies, and billing cycles are governed by Atlassian's Marketplace policies.
Before the App exits beta and post-beta pricing takes effect, the new pricing will be published on the Atlassian Marketplace listing and existing users will be notified. You may continue using the App under the new pricing or uninstall it.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
Key Point: Project Commander does not store your Jira data outside of Atlassian's infrastructure. All data access is performed through Atlassian's secure APIs.
Project Commander includes optional AI-powered features. These are disabled by default and only activate when you explicitly trigger them after supplying your own API key from a supported AI provider (Anthropic, OpenAI, or Google Gemini). When you trigger an AI feature:
You are responsible for ensuring you have the necessary permissions to install and use the App within your Jira instance.
Project Commander, including its code, design, and documentation, is protected by copyright and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
You retain all rights to your Jira data. We claim no ownership over any data you access or manage through the App.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant that:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
This limitation applies regardless of the theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Project Commander and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

We will make reasonable efforts to notify users of significant changes through the Marketplace listing or App interface.
You may stop using the App at any time by uninstalling it from your Jira instance.
We may suspend or terminate your access if you violate these Terms or engage in conduct that harms the App or other users.
Upon termination, your license to use the App ends immediately. Uninstalling the App removes all App data stored in Atlassian Forge storage — including configuration, velocity history, sprint snapshots, team capacity, risks, action items, retrospectives, governance policies, portfolio data, alert dismissals, the AI prompt-enrichment cache, and the AI API key (held in Forge encrypted secret storage). Your Jira data is unaffected.
These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Project Commander regarding the App.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
We may update these Terms from time to time. We will notify users of material changes through the Marketplace listing or App interface. Your continued use of the App after changes constitutes acceptance of the updated Terms.
